    The local Houston news if full of all this –

    ….. indeed since his conviction was going to be appealed, the legal precedence from prior 5th Circuit rulings is that all proceedings will be tossed out, and his initial conviction expunged from the record (i.e. as if his appeal were successful).

    Likewise, because of that, the Feds cannot now legally pursue the “criminal” avenue of recovering some $43 million in Lay personal assets.

    The Feds can attempt a “civil” action to recover funds, however they would also first have to first retry the case “civically” to reprove that he was guilty – i.e. since all “criminal” charges are to be thrown out.

    Thus it appears that his wife and children will come out “better” in a financial sense by his untimely death.

    The news is now reporting legal issues regarding getting to his wealth. They might not get it now.... noticed his passing was in Aspen....
    The death sounds too fishy to me...of one sort or another.

    At first when I heard that Ken Lay was dead my intial thought was suicide. That man' heart probably just couldn't take the thought of spending the rest of his life in prison.

    It was sad that his life ended the way it did...I hope that he asked the Lord for forgivness and is with Jesus now. Sad for his family too.

    Just 3 or 4 days ago it was reported in the Houston press that the gov't was seeking a so called "money judgement" - against both Lay and Skilling - i.e. where they could go after any and all remaining assets (money, homes, cars, etc) that could be located now or in the future...

    His attorney was up in arms since it meant that he would be left out in the cold in so far as ever collecting the 10s on millions owed for defense...

    Likewise it was reported that they had already turned up several million in unreported Lay investments that he failed to list...

    He was facing 20 to 25 years without parole and his wife becoming a pauper - thus my first thought was that he likely had a life insurance policy worth millions - i.e. that the feds could not touch - and typically in these policies the suicide clause exemption only covers the first 5 years...

    Yep, things weren't looking too good for him...so who knows? But it will be determined for sure.

    I don't disagree

    ..... however my point was these were "actual initial news reports" - I saw a couple of them myself, as well as my wife - i.e. regarding initial reports of a suicide... and neither of us captured the actual article at the time...

    The when Reuters reported it I decided to post it here just as an FYI - hopefully they were errornous - certainly the autopsy will confirm...

    Wikipedia, an online encyclopedia that anyone can edit, added news of Lay's death to his online biography shortly after news outlets began reporting it at around 10 a.m. EDT (1400 GMT).

    At 10:06 a.m., Wikipedia's entry for Lay said he died "of an apparent suicide."

    At 10:08, it said he died at his Aspen, Colorado home "of an apparent [[heart attack] or suicide.]."

    Within the same minute, it said the cause of death was "yet to be determined."

    At 10:09 a.m., it said "no further details have been officially released" about the death.

    Two minutes later, it said: "The guilt of ruining so many lives finally led him to his suicide."

    At 10.12 a.m., this was replaced by: "According to Lay's pastor the cause was a 'massive coronary' heart attack."

    By 10:39 a.m., Lay's entry said: "Speculation as to the cause of the heart attack lead many people to believe it was due to the amount of stress put on him by the Enron trial." This statement was later dropped.

    very unethical on their part
    I do believe that was their "status quo" - job #1. It's over now, but the damages linger on, especially for senior citizens who got burned.

    Likewise in a former business venture I was a partner in some years back (small business) we were steam-rollered by Enron as one of our clients - very unethical on their part.

    I saw that this morning too. Age 64--heart attack. Sad end. I didn't follow the details of the Enron case, it made me too mad just thinking about how many people were "robbed" of their life savings, etc at the ands of the corporate thieves. Enron is not the only one out there doing that.

    I hope he knew the Lord, Fox News reports that he was a member of
    a methodist church in Texas. I know he commited a crime that effected
    a lot of people, but maybe he asked God to forgive him.
